General Terms and Conditions - AGB
Contractual partners and conclusion of contract
Bookings and voucher orders constitute a contract with Sakura Spa GmbH, Poststrasse 14, 9000 St. Gallen, commercial register number CHE-338.570.885. Every order is binding. By placing the order, the customer concludes a valid purchase contract with Sakura Spa GmbH and undertakes to pay for the goods and to accept them. The customer is notified of every voucher order by email. By clicking on the terms and conditions field during the ordering process in the voucher web shop, the customer confirms that he has read and accepted the terms and conditions. Only the German language is available for concluding the contract.
Voucher purchase & voucher validity
When purchasing a voucher, the customer accepts the valid terms and conditions.
All vouchers are value vouchers
If you purchase a voucher for a treatment, this is considered a suggestion for the recipient. They can book another treatment for the same voucher value at any time, or even a higher-priced treatment, and the difference can be paid on site when redeeming the voucher.
All vouchers are valid for 3 years from the date of issue.
After this period has expired, Sakura Spa GmbH is no longer obliged to accept them. Lost vouchers will not be replaced. Vouchers cannot be returned for cash either. Sakura Spa GmbH has no right to demand payment if someone tries to redeem several vouchers with the same voucher number, even if the first redeemer is not the legal owner of the voucher.
postal shipping costs
The shipping costs for vouchers sent by post are CHF 4.50. These shipping costs are not included in the voucher price, but are charged in addition to the voucher value. Postal delivery is only possible within Switzerland or Liechtenstein.
Complaint / Exchange
It is not possible to take back vouchers and goods that have been correctly delivered by us. In cases of complaints about incorrectly delivered goods, processing is only possible with a copy of the order in the online shop.
delivery conditions
We endeavour to keep our online offers up to date at all times and to send the ordered vouchers, which are not printed online but are to be sent by post, by A-Post immediately upon receipt of payment, normally within two working days, but we cannot accept any liability for this. If you have not received the postal shipment after 5 days, please contact us immediately.
refusal of acceptance
If the acceptance of the delivered goods is refused without justification, we will invoice the costs incurred, but the fulfillment of the purchase contract remains unaffected and legally valid. If the acceptance of the goods delivered by us is refused without justification, we will invoice the costs incurred. Our right to fulfill the purchase contract remains unaffected.
payment instructions
Payment in the voucher webshop can be made either by Twint or credit card: The online transmission of the credit card information is encrypted via the security certificate, which guarantees a secure payment method.
appointment bookings / appointment cancellations
When booking an appointment, a contract is concluded with Sakura Spa GmbH.
You will receive a booking confirmation by email with the booked treatment, time, date and cancellation conditions.
If you are unable to keep your appointment, the following apply Cancellation conditions:
- Up to 48 hours before the appointment: no cancellation fees
- Up to 24 hours before the appointment: 50% cancellation costs
- Less than 24 hours before the appointment: full amount of the service
- When making a reservation, the customer accepts the valid terms and conditions.
Necessary personal data
We can only process orders properly if we are provided with correct, valid and complete information. We will not pass on your personal data to third parties. This does not include the passing on of information that is necessary for the proper processing of a sale or a legal or judicial obligation to transmit your personal data to authorized bodies. We only collect the information that is suitable and necessary to process an order. In return, however, we can only process an order without delay if we have correct (especially current) and complete information available.
Change General Terms and Conditions
These General Terms and Conditions may be amended at any time and will then take effect immediately.
Applicable Law
These general terms and conditions and the use of the voucher webshop are subject to Swiss law. The place of jurisdiction for natural or legal persons is St. Gallen.
Alternative dispute resolution according to Art. 14 para. 1 ODR-VO and § 36 VSBG:
The European Commission provides a platform for online dispute resolution (ODR), which you can find at https://ec.europa.eu/consumers/odr We are neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.

If any part of these Terms and Conditions is found to be unenforceable or invalid for any reason, this will not affect the validity of the remaining provisions.
